Illegally Charging for an Auto Electrical Job

Contacted Auckland Mobile Mechanics (AMM) at 1620 hrs, and the lady on the desk said they would come between 8-9am on Saturday the next day

AMM Rang up at 1304 and said they would come between 1400 and 1500
1440: Simon arrived and checked the window for 5-7 minutes and told me it was broken electric motor. When asked regarding the cost he said it would be $394 plus labour - did not explicitly mention the TOTAL cost or what labour cost was, and the price he told me was not GST inclusive - of which I was not aware.
1445: said he would contact base to ask if they had my part in stock, and needed credit card detail for my parts.
1447: Said he would come back on Monday with the parts to fix my car
1448: No receipt or invoice was given and did not inform me that he had already charged for a job that hadn't even started.
1500: Checked my online credit transaction to find $662.65 in my credit card statement
1502: Rung the company and stated I wanted a refund of the money to the lady at the desk and wanting to speak with technician, she said she would get technician to call me back'
1510: I decided to ring them myself - technician got put on the line and told him I don't want to go through with the job and would like my money back. He said he could arrange for it to be cheaper
I said "No, I want my money back - I will pay for the call out fee of $70 but not the rest of the money. Service manager wasn't available so he said he would talk to the service manager on Monday
1600: My mother them called back again and as above, got the job number, the name of the mechanic. Told them that we wanted our money back - she was told that he would arrange for the service manager to sort it out on Monday
and that they would call us.

Got in touch with the Citizens Advice Bureau with the Sylvia Park for legal advice.
Contacted AMM at 0920
Spoke with Simon, He said the general manager will sort it out for me - re: credit card charge at 1000hrs.
I told him that by charging me without a correct quote, and no invoice and using my credit to charge without telling me was ILLEGAL. I informed him that if they
didn't return my money in 24hrs I would file a court hearing with the disputes tribunal.

0945hrs: Beena Shukla rang back and provided the email and said I needed to email her my bank acc for her to give me back my money
She said it would be go through tomorrow - Tuesday.
Got her email, name. She said she would refund me the full price.
And that she would email me back as well.

1138: States she will direct debit it to BNZ account as the Cooperative bank number is not working. She said that the last three numbers
would not fit into the slot for the bank account AP. She also added that they would only charge me the call out fee of $78.87 (incl GST) .
So I gave her my BNZ acc and got another call in 5-10mins with the same reason and stating the problem above.
This time by Simon had rung on the phone to tell me that they couldn't pay me back through bank acc. I told them that both bank acc I gave them is correct.
If they wouldn't find a way of paying me pack I would file a court hearing with the disputes tribunal and bluffed me and said if I did that he wouldn't intend to show up to the hearing.
By this time I was fed up with their stalling. He was also getting aggressive on the phone, and told me that if I continued to be aggressive with him he wouldn't
pay us back our owed money. I told him I can pick up a cheque and to give us the address - which he refused to give. So I asked to speak with Beena Shukla - and he said aggressively that
"she can't help you now, she's not gonna be fix it for you. Why do you need to speak with her and hung up."

1145: Called back on the landline number and got hold of Beena Shukla and told her what the exchange was with Simon - and she denied what he meant by what he was saying
I told her she that they had cheated me and I want my money back. I told her I can pick up a cheque and to give us the address.

In the end, after a lot of phone calls and legal quotations and references of the Dispute Tribunal, I managed to get my money back.

These guys are ridiculous! Glad you managed to get your money back. I am taking them to the disputes tribunal as well.
